Privacy Notice

1. OUR APPROACH

1.1 This Privacy Notice sets out how we the Donaldson group of companies with global headquarters at 1400 West 94th Street, Bloomington, MN 55431 (further referred to as “Donaldson”, “our” or “we”) process the Personal Information of our website visitors, customers, and suppliers.

2. WHAT IS PERSONAL INFORMATION?

2.1 ‘Data Subject’ is any natural person, and, where country specific applicable law so provides, a juristic person.   Personal Information means any information relating to a Data Subject who can be identified either directly or indirectly; it may include for example: name, address, email address, phone number, credit / debit card number, IP address, or location data.”

3. TYPES OF PERSONAL INFORMATION WE PROCESS

3.1 Contact Information – such as name, work address, phone numbers, email address and similar

3.2 Details of your relevant professional experience and interests – such as your employer and products/business capabilities for which you have interest and/or responsibility

3.3 Financial information needed to support business transactions – such as credit card details, credit worthiness, bank account information

3.4 Information required to support regulatory reporting requirements such as race, ethnicity, gender and veteran status of our suppliers and business partners

3.5 Website usage – such as browsing history, IP address, content submitted on web forms, account login ID’s and passwords

3.6 Site visitor information and CCTV images for visitors to Donaldson physical locations

3.7 Geolocation, facility and vehicle information captured for and about specific Donaldson products - including Connected Solutions and iCue, that could incidentally be related to a Data Subject

4. PURPOSES FOR WHICH WE MAY PROCESS PERSONAL INFORMATION

4.1 Donaldson will only process your Personal Information, in accordance with applicable law, for the following purposes:

4.1.1 offering our goods and providing our services to you in a personalized way, for example, we may provide suggestions based on your previous searches to enable you to identify suitable goods and services more quickly;

4.1.2 enabling our suppliers and service providers to carry out certain functions on our behalf, including payment processing, verification, technical, logistical or other functions, as may be required, in order to fulfil your orders;

4.1.3 sending you marketing communications, in order to keep you informed of our products and services, which we consider may be of interest to you;

4.1.3.1 These communications may reference any of the Donaldson brands or Affiliates including: Filter Minder, Hy-Pro, BOFA, Partmo, Solaris Biotech, Purilogics, PAIS Industrial Services, Isolere Bio and Univercells Technologies

4.1.4 serving advertising to your devices; delivering ads based on your interests ascertained from your past searches, visits of subpages and purchases on our websites, and other data obtained through the use of "cookies" placed on your devices. Please see our Cookie Statement below.

4.1.5 ensuring the security of your account and our business, preventing or detecting fraud or abuses of our website, for example, by requesting verification information in order to reset your account password;

4.1.6 developing and improving our products and services, for example, by reviewing visits to our website and its various subpages, demand for specific goods and services;

4.1.7 to comply with applicable law, for example, in response to a request from a court or regulatory body, where such request is made in accordance with the law;

4.2 The bases for processing your Personal Information for the purposes described above will include: 

4.2.1 to fulfil a contract that we have in place with you;

4.2.2 for Donaldson’s legitimate business interests;

4.2.3 you provided us with your consent or

4.2.4 for compliance with a legal obligation to which Donaldson is subject.

4.3 You may request to withdraw your consent for specific processing activities where the basis for processing is consent by contacting us via the contact information listed in this Privacy Notice.

4.3.1 After we receive a request from you to withdraw your consent for certain processing activities, we will not process your personal information for the identified activities. 

4.3.2 Withdrawal of consent will not affect processing previously carried out based on your consent.

4.3.3 To the extent that processing your personal information is required (e.g. the basis for processing is a legal requirement or contractual obligation), we may continue processing your personal information.

5. DISCLOSURE OF PERSONAL INFORMATION

5.1 There are circumstances where we wish to disclose or are compelled to disclose your Personal Information to third parties. This will only take place in accordance with the relevant applicable law and for the purposes listed above. These scenarios may include disclosure:

5.1.1 to our subsidiaries, affiliates, or associated offices (for list of affiliates please see section 14 below);

5.1.2 to our outsourced service providers or suppliers to facilitate the provision of our services or goods;

5.1.3 to our advertising partners who enable us to deliver advertising;

5.1.4 to third party service providers and consultants in order to protect the security or integrity of our business, including our databases and systems and for business continuity reasons;

5.1.5 to our dealers and distributors in order to provide sales and service support;

5.1.6 to another legal entity, on a temporary or permanent basis, for the purposes of a joint venture, collaboration, financing, sale, merger, reorganization, change of legal form, dissolution or similar event. In the case of a merger or sale, your Personal Information will be permanently transferred to a successor company;

5.1.7 to third parties who are verifying our supplier diversity and sustainability reporting;

5.1.8 to public authorities where we are required by law to do so

6. INTERNATIONAL TRANSFER OF PERSONAL INFORMATION

6.1 We may transfer your Personal Information to a third party in countries outside the country in which it was originally collected for further processing in accordance with the purposes set out in section 4 above. In particular, your Personal Information may be transferred throughout the Donaldson group and to our outsourced service providers located abroad. In these circumstances we will, where required by applicable law, ensure that your privacy rights are adequately protected by appropriate technical, organization, contractual or other lawful means. 7. RETENTION OF PERSONAL INFORMATION

7.1 Your Personal Information will be retained as long is reasonably necessary for the purposes listed above or as required by applicable local law.

7.2 The criteria used to determine our retention periods include:

7.2.1 Whether there is a legal obligation to which we are subject

For example, where laws or regulations require that we keep records of your transactions for a certain period of time, to comply with accounting, or tax rules, or as required in support of litigation or regulatory investigations

7.2.2 Whether you have given us consent to communicate with you

For example, you have indicated you want information on our products and services

7.2.3 The length of time we have an ongoing relationship with you

For example, as long as you/your organization keep using our products and services

8. DATA PRIVACY RIGHTS

8.1 Data privacy law provides Data Subjects in certain jurisdictions, including but not limited to: the EU, UK, Switzerland, South Africa, the state of California in the United States, People's Republic of China ("PRC"); with numerous rights, including the right to: access, rectify, erase, restrict, transport, and object to the processing of, their Personal Information.

You can exercise the rights described in Section 8 by sending us a written request by letter or email to the address set out in Section 14 below.   After we verify your identity and determine our obligations, we can (as required or requested) ascertain the Personal Information we maintain about you. We reserve the right to redact or withhold data that you are not entitled to receive under applicable laws (e.g., data revealing information about another individual). Data Subjects may also have the right to lodge a complaint with the relevant data privacy authority if they believe that their Personal Information is not being processed in accordance with applicable data privacy law.

8.2 California Residents

With certain exceptions, as a California resident, you have the right to opt out of the ‘sale’ or ‘sharing’, as defined under California law, of your Personal Information to third parties, including as detailed in the ‘Cookies and Opting Out’ section below. If we sell your Personal Information to a third party, you have the right to request that your Personal Information is not included in the sale of any data.  To exercise this right you may do so by selecting the California: Do Not Sell or Share My Personal Information link in the footer of the Donaldson.com website

9. PROTECTING PERSONAL DATA

9.1 We employ reasonable security measures to protect the security of any information you give to us.  Nevertheless, such security measures cannot prevent all loss, misuse or alteration of Personal Information.  In the event of damage to our physical, technical or management protections which results in unauthorized access, public disclosure, tampering with or destruction of the information, which results in the compromise of your lawful rights and interests, we will fulfill our obligations consistent with our policies and applicable regulations.

If any security incident occurs that involves Personal Information, we will, to the extent required, inform you of the following: basic information about and possible impacts of the security incident, measures we have taken or will take in response, and suggestions for further risk prevention and reduction that you may take.  Notice will be provided by, for example email, letter, phone, push notice or other means in a timely manner.  Where individual notice is impractical, we will publish announcement in reasonable and effective ways.

We will also, when required, proactively report security incidents including those involving personal information to the appropriate regulatory authorities

10. CHILDREN

10.1 Please note that this website is not intended for children under the age of 18. In the event personal information of an individual under the age of 18 is obtained by Donaldson, we reserve the right to delete such information in accordance with applicable law.

11. COOKIE STATEMENT

11.1 What exactly are cookies?

In order to collect the information as described above, we may use cookie and similar technology on our website.

11.2 A cookie is a small piece of information which is sent to your browser and stored on your computer's hard drive, mobile phone or other device. Cookies can be first party or third-party cookies.

11.2.1 First party cookies: cookies that the website you are visiting places on your computer

11.3 Cookies allow collection of information such as browser type, time spent and path followed on the site, language preferences and other traffic data. We may utilize the information collected for various purposes including analytics and measuring the effectiveness of our marketing campaigns.

12.1 We may partner with companies who provide analytics and advertisement services on our behalf across the web. The entities may use cookies, web beacons, device identifiers and other tracking technologies which collect information about your use of this and other websites. This information may be transmitted to a server in the United States and saved there.
